2. Information We Collect a. Personal Information:

  • Clients: Name, email address, phone number, delivery address, payment details, and order history.
  • Restaurant Owners: Business name, contact details, menu offerings, payment preferences, and related operational data.
  • Website Visitors: Non-identifiable information such as IP address, browser type, and activity tracked via cookies.


3. How We Use Your Information

  • To process orders, arrange deliveries, and facilitate payments.
  • To manage restaurant partnerships and vendor coordination.
  • To communicate updates, order confirmations, and special offers.
  • To improve website functionality and service experience.
  • To comply with applicable laws, resolve disputes, and enforce agreements.
  • SMS / Text Messaging (Transactional / Operational)
    HEHA may send transactional and operational text messages related to order coordination and partner communications, including order notifications, acceptance/confirmation, order changes, pickup/delivery coordination, and support. Message frequency varies based on operational needs. Message and data rates may apply. You can opt out at any time by replying STOP. 4. Sharing Your Information

  • With Restaurants: For fulfilling orders.
  • With Service Providers: Including delivery drivers, payment processors, and communication tools, under strict confidentiality.
  • For Legal Compliance: When required by applicable law, court order, or government request.
  • No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties except as required to provide the messaging service.


5. Data Security We take commercially reasonable measures to protect your information. However, no method of internet transmission or storage is completely secure, and we cannot guarantee absolute protection.


6. Cookies and Tracking We use cookies to improve your browsing experience. You can manage cookie settings via your browser. Disabling cookies may affect some site features.


7. Your Rights & Choices

  • Access, update, or correct your personal information.
  • Request deletion of your personal data (subject to legal limitations).

TERMS

Effective Date: April 11, 2025


1. Introduction
These terms and conditions ("Terms") govern the meal delivery services ("Services") provided by Healthy Habit LLC ("Company") in collaboration with local restaurants ("Restaurants") and independent drivers ("Drivers"). By utilizing our Services, you ("Client" and/or "Restaurant") agree to these Terms.


2. Service Details
Healthy Habit LLC partners with local restaurants to offer nutritious, organic meals, snacks, and beverages with minimal processing and no artificial ingredients. Like traditional delivery apps, menu items are shown on our website and can be pre-ordered. After receiving an order, HEHA coordinates with restaurants and dispatches a driver to pick up and deliver the food. All deliveries require a minimum of two days’ advance notice. The service includes:

  • A curated menu of meal options, customizable for vegan, vegetarian, and carnivore diets.
  • Orders are available for individuals or groups and do not require platters.
  • Basic dietary requests (e.g., onions/peppers on the side) can be accommodated when possible. 
  • Out-of-Zone Deliveries & Distance Surcharges (Paylink After Confirmation)
    HEHA deliveries are priced for service within our standard delivery zone (currently up to 15 miles from the applicable pickup/dispatch point, unless otherwise stated). If a delivery address is outside the standard zone, a distance surcharge will apply at $1.25 per mile beyond 15 miles, calculated one-way from the pickup location to the delivery address.
    If a surcharge applies, HEHA will notify the client after order confirmation and will send a separate payment link (“Paylink”) for the distance surcharge. The surcharge is due upon receipt of the Paylink and must be paid before delivery is completed. If the surcharge is not paid prior to arrival/handoff, delivery may be paused, rescheduled, or cancelled, and the client may be responsible for costs already incurred.


3. Client Obligations

  • Clients must submit accurate delivery addresses and preferences.
  • While we recommend a minimum of 10 portions per meal delivery for efficiency and value, this is not mandatory. For best value, clients are encouraged to order 15–20 portions, as the shipping fee remains fixed until free or reduced delivery thresholds are met. Minimum order quantities for snacks and beverages may differ and will be communicated separately.


4. Restaurant Obligations

  • Use fresh, organic, and locally sourced ingredients where possible.
  • Adhere to all local health and food safety regulations.
  • Provide consistent menu items and update availability as needed.
  • Honor simple dietary preferences.


5. Company Obligations

  • Provide order details to Restaurants including preferences, portion sizes, and instructions.
  • Manage client payments through custom paylinks.
  • Coordinate and dispatch Drivers based on the scheduled time frame.


6. Pricing, Fees, and Payment

  1. Menu Pricing. Menu prices displayed on the HEHA website include applicable HEHA service fees associated with coordinating orders and delivery operations. Taxes and payment processing fees may apply and will be shown at checkout where applicable.
     
  2. Transportation / Delivery Fees (per order). Transportation fees are charged per order based on HEHA Community Pass status and order subtotal (pre-tax, excluding delivery/transportation). Current transportation fees are:
     
    • HEHA Community Pass Members: $12.50 transportation fee for subtotals under $300; $0 transportation fee for subtotals $300+.
       
    • Non-Members: $24.50 transportation fee for subtotals under $140; $18.50 transportation fee for subtotals $140+.
       

  1. Community Pass. Clients may optionally enroll in the HEHA Community Pass for discounted transportation fees and other benefits as described on the HEHA website. Pricing is currently $15/month, $50 for 6 months, or $100 for 12 months (subject to change with notice).
     
  2. Restaurant Payments. Restaurants are paid according to the agreed wholesale pricing and payment method(s) established with HEHA (ACH preferred). Restaurants are not charged delivery/transportation fees by HEHA unless separately agreed in writing.
     
  3. Changes. HEHA may update pricing, transportation fees, and Community Pass pricing from time to time. Any changes will be posted on the website and will apply prospectively.


7. Liability and Insurance

  • Restaurants must maintain their own food safety and liability insurance.
  • HEHA is not liable for any food quality or delivery issues once meals are picked up.
  • Drivers are independent contractors. HEHA is not responsible for delays or issues caused by Drivers but will help coordinate resolutions if needed.


8. Confidentiality and Privacy

  • All parties agree to safeguard sensitive and proprietary information.
  • Client data may only be used for service fulfillment and cannot be shared with third parties.

9. SMS/Text Messaging Terms (Operational/Transactional)

By providing your phone number and using our services (clients) or entering a service partnership with HEHA (restaurants/vendors), you authorize HEHA to send transactional/operational text messages related to orders and coordination (e.g., order notifications, confirmations, changes, pickup/delivery coordination, support).

  • Opt-out: Reply STOP to cancel text messages at any time.
     
  • Help: Reply HELP for assistance or contact hello@heha.online / 813-606-3781.
     
  • Message frequency: Varies based on order volume and operational needs.
     
  • Rates: Message and data rates may apply.
     
  • No marketing texts by default: Promotional/marketing messages are only sent if you separately opt in.


10. Termination Clause

  • Either party may terminate service with 4 weeks' notice.
  • Immediate termination applies for any material breach.
  • Cancellations within 36 hours of delivery may result in cost reimbursement to HEHA.


11. Dispute Resolution

  • Disputes will be settled via mediation or arbitration under local laws.


12. Miscellaneous

  • These Terms are the entire agreement unless modified in writing.
  • Changes must be mutually agreed upon and signed.
  • Last-minute cancellations or time/date changes may incur a $30 fee.
  • Deliveries are limited to a 15-mile radius. For any additional distance, a rate of $1.25 per extra mile is applied. This rate accounts for round-trip driver expenses and may be subject to change as fuel prices and delivery logistics fluctuate.
  • This service empowers local restaurants, encourages healing foods, and supports driver efficiency.
  • 20% of HEHA profits fund the Freebird Fund, helping individuals transition from homelessness to van living.


13. Force Majeure
Neither party is liable for failure to fulfill obligations due to uncontrollable events (e.g., natural disasters, pandemics, war).
